who is starting this thread at TCC?  :)

That is where I first saw it and then I started a thread here.

Dang... I wish I could see the thread on TCC right now.  I bet that one is going well ;)

K, nobody is touching it, I haven't seen anything posted in quite sometime.

H

Eerily quiet.  I'm waiting for the helicopters, spotlights and men in black to arrive at my house.

I just wish that the board kept these discussions a little more civil, with a little less name calling.

To call someone "xerox" with a trademark infringement in your avatar is a little ironic, don't you think?

The opinions expressed are those of the poster and do not in any way reflect those of the board/moderators/infinite monkeys.

Redistribution is forbidden without the expressed written consent of Mr. Doug.  :)

Well, now here's the thing Tom.  You don't get to say people are uncivil name-callers, and then post your own brand of name-calling.  That's un-civilized.

BTW, how much did you sell your KoolAid headcover set for?

No offense intended.

OK, again, I agree...the Mills and Byron are less "alike" than Jackpot Johnny.  So what about Bettinardi and Koolaid?  There is no modification there...and Koolaid is still sold in stores today, and is more widely distributed than those playing cards.  (i.e. I've actually heard of Koolaid before...)  I just wish that the board kept these discussions a little more civil, with a little less name calling.

No offense taken.  Bettinardi is not claiming to have created the Kool Aid logo.  There are plenty of examples of parody in company logos out there.  Bettinardi doesn't sell powdered drink mixes so I'm guessing there is no problem from the Kool Aid company anyway.  I don't see the irony at all.

Just reinforces the nickname  "Xerox" LOL.

Chris

Actually, I heard that it was Lee Trevino who once while walking by the putting green and called Cameron "Hey Xerox ! how you doing !?"
I could stick with only just one putter, but, what fun would that be?

Just pointing out irony John.

I didn't think that was insulting, simply observing.  If you are offended, heart-felt apologies...it wasn't intended.

And thanks for the hc fs plug. ;)

Here's the deal...some on another forum seem to question why I contacted Pieter Woudt.  For me, we could speculate and speculate.  Some even hinted that the design was stolen from Scotty.  Or, here's a crazy notion, we could contact one of the men in question.  His number and email address were right there on his website for the world to see.  He could have easily responded with:

Scotty and I are buds.  I told him to use it.
Scotty is a client.
I sold the image to someone and Scotty purchased the rights from them.
I found that image in the public domain and so anyone can also use it.

I would have posted any of those responses.  If I had, would I then be a hero?  It's not a plot by me to get Scotty.  I have no reason to lie.  However, that is not what he told me.  He said he created that image in 2002 or 2003 and didn't know it was being used AT ALL.  This seems like the best ever use of this phrase:  don't shoot the messenger.

I guess that from a legal standpoint, Koolaid is trademarked and therefore shouldn't be copied without written consent from the Oh-Yeah dude that busts through walls.

If Pieter did in fact trademark his design on the playing cards, then Don and Titleist are gonna be in some trouble.  If he didn't, then Don or John or you or I is free to use it.  It may not be morally correct to do so, but it isn't breaking any laws.

Chris, nothing personal...I just thought that it was kinda funny that you said xerox with the betti bag tag...that's all.  Apology and olive branch formally extended.

I guess he didn't say "Oh-No!" since Bettinardi has been producing them for some time.  But as an earlier discussion stated, the designs are different, although not noticable when apart.

Atomic, I think that is correct, but I have zero legal persepective.

Re: your KoolAid FS, just observing irony.

Anyway, how about a new contest on PT.  We'll call it:  "Justify Cameron's Latest".

So far, we have these entries:

1.  Maybe he had permission to use it.
2.  Maybe someone else had permission to use it.
3.  The colors are different.
4.  Other people do it.
5.  It was ugly anyway.
6.  Anyone with a KoolAid avatar can just shut up.
7.  Maybe it's not protected.

Any others?

Lordy, what a hornets nest I have stirred on a different forum!  Apparently, I was wrong to contact the graphic artist before giving Scotty a 'heads up.'  In addition, I should have contacted the mods for a reason I have yet to figure out.  AND there is some who think Scotty would OWE ME ONE for bringing it to his attention.  Somehow, I doubt that.

I fear I may soon be black balled or black (oxide) balled, as it were in the putter community.

I will not disappoint either. It is just too similar.

My scenario....maybe Cameron was in Vegas taking back one of TW's back ups so he could give them to a distributor. TW was still getting busy in his hotel room so Cameron walks on to the casino floor and saw these on the back of a deck of cards and got inspired. However he thought putting "Inspired by Pieter Woudt" probably have the cash register ringing as "Jackpot Johnny" so he went with that.

Just as I vehemently protected Cameron's "cherry dot" and objected the use of it by another putter guy. (I even contacted that putter guy as well I have to ask his views.) I have to make my stand with Pieter on this one.

This wouldn't be such an issue if there was any statement saying it was a tribute to this design. Byron, Bettinardi, and Mills all acknowledge it in some form. Cameron did it with Leica, why can't he do it nowadays?

Because he's lost his moral compass.  I truly believe he thinks he's above the rules.  He really screwed the pooch this time though.

With all due respect to those complaining, you don't owe Cameron a single nickel.  Giving Scotty a heads up, please!  Scotty is a businessman, if he doesn't know what is going on in his company then that is a problem.  Is not your job to contact Cameron about this, that is inmature and stupid to even suggest that you have to do that.

Bring out the violin, please.

Your "mistake" was in failing to assume that Cameron would never do anything wrong.  Worse, you did your own investigation to determine the facts, instead of accepting the "party line".

That won't get you blackballed here.

Pieter Woudt is just jealous that Scotty liberated his character from playing cards and gave it cool name and a new life adorning golf headcovers.  Scotty can feel that jealousy.

I'm not really concerned about being black oxide balled. I just thought it was a funny term and wanted an excuse to use it!

Fact is, I stand by everything I have written on either forum. I've tried to be objective and I haven't jumped to any conclusions nor made any accusations. However, my gut tells me this is going to be a difficult one for Scotty to explain.

Another nice picture of the cards. They are sold at www.kikkerland.com per 12 decks in a display. Nice to have I'd say!

I agree with you. The only thing Scotty can do IMO is tell his side of the story. Based on what I know now it doesn't look good for him.

And Pieter Woudt is a fellow Dutchman... DON'T MESS WITH THE DUTCH!  >:(
